GENERAL TERMS AND CONDITIONS


1 Scope

 

1.1 These General Terms and Conditions (hereinafter "GTC") of Creating Numbers GmbH (hereinafter "Seller") apply to all contracts for the delivery of goods concluded by a consumer or entrepreneur (hereinafter "Customer") with the Seller regarding the goods presented by the Seller in its online shop. The inclusion of the Customer's own terms and conditions is hereby rejected, unless otherwise agreed.

1.2 These terms and conditions apply accordingly to contracts for the delivery of vouchers, unless otherwise stipulated in this respect.

1.3 Consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their independent professional activity.

1.4 Entrepreneur within the meaning of these GTC is a natural or legal person or a legally capable partnership who acts when concluding a legal transaction in the exercise of their commercial or independent professional activity.


2 Conclusion of contract

 

2.1 The product descriptions contained in the seller's online shop do not constitute binding offers on the part of the seller, but serve to submit a binding offer by the customer.

2.2 The customer can submit the offer via the online order form integrated into the seller's online shop. In doing so, after placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the customer submits a legally binding contract offer regarding the goods contained in the shopping cart by clicking the button that completes the ordering process.

2.3 The seller can accept the customer's offer within five days,

by sending the customer a written order confirmation or an order confirmation in text form (fax or e-mail), whereby the receipt of the order confirmation by the customer is decisive in this respect, or

-by delivering the ordered goods to the customer, whereby the receipt of the goods by the customer is decisive,

by requesting the customer to make payment after placing their order.

If several of the aforementioned alternatives are present, the contract is concluded at the time when one of the aforementioned alternatives occurs first. The period for accepting the offer begins on the day after the offer is sent by the customer and ends at the expiration of the fifth day following the sending of the offer. If the seller does not accept the customer's offer within the aforementioned period, this is considered a rejection of the offer, with the consequence that the customer is no longer bound by their declaration of intent.

2.4 When selecting an instant payment system (e.g., PayPal Express, Amazon Payments, Sofortüberweisung), the customer is either directed to the order overview page in our online shop or redirected to the website of the provider of the instant payment system. If a redirection to the respective instant payment system occurs, the customer makes the corresponding selection or enters their data there. In this case, the seller hereby declares acceptance of the customer's offer at the moment the customer initiates the payment process by clicking the button that completes the order process. Finally, the order data is displayed to the customer as an order overview on the website of the instant payment system provider or after they are redirected back to our online shop.

2.5 When submitting an offer via the seller's online order form, the contract text is stored by the seller after the conclusion of the contract and sent to the customer in text form (e.g., email, fax, or letter) after the customer's order has been sent. The seller does not provide any further access to the contract text. If the customer has created a user account in the seller's online shop before sending their order, the order data will be archived on the seller's website and can be accessed by the customer free of charge via their password-protected user account using the corresponding login details.

2.6 Before the binding submission of the order via the seller's online order form, the customer can detect possible input errors by carefully reading the information displayed on the screen. An effective technical means to better detect input errors can be the browser's zoom function, which enlarges the display on the screen. The customer can correct their entries within the electronic ordering process using the usual keyboard and mouse functions until they click the button that completes the ordering process.

2.7 The German and English languages are available for concluding the contract.

2.8 Order processing and contact are usually conducted via email and automated order processing. The customer must ensure that the email address provided for order processing is correct so that emails sent by the seller can be received at this address. In particular, when using spam filters, the customer must ensure that all emails sent by the seller or third parties commissioned by the seller for order processing can be delivered.


3 Due date
The payment of the purchase price is due within one week after the conclusion of the contract.


4 Retention of title
The delivered goods remain the property of kohlenstoff 12 until full payment is made.


5 Prices & Shipping Costs
The prices stated include the statutory value-added tax. Any shipping costs will be communicated to the customer in a timely manner before completing the order process.


6 Delivery
(6.1) Delivery of ordered goods within Germany usually takes place within 1-3 working days after receipt of payment, within Europe 2-10 working days, and outside 5-20 working days.
(6.2) All information about expected delivery dates is non-binding, unless they have been expressly agreed upon as binding.

(6.3) The delivery times stated in the shop do not apply to custom-made products and spare parts. The delivery time for these depends on the respective effort and the current order situation.



7 Guarantee
Carbon 12 generally does not assume any warranty obligations beyond the statutory warranty, unless an additional warranty statement is made in the product description for individual goods. 



8 Exercise of the right of withdrawal

9 Choice of Law & Jurisdiction
(9.1) The contractual relationships between carbon 12 and the customer are governed by the law of the Federal Republic of Germany.
(9.2) The place of jurisdiction for all disputes arising from the contractual relationship between the customer and kohlenstoff 12 is the provider's registered office.

10 Possible damages to third-party products
(10.1) carbon 12 explicitly points out that wearing third-party products together with our offered items can lead to damage. No claims for damages of any kind can be made by the customer for any type of damage.



11 Payment via Klarna (Invoice, Installment Purchase & Pay Now)

In cooperation with Klarna AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you invoice purchase, installment purchase, and immediate payment as payment options. Please note that Klarna invoice, Klarna installment purchase, and Klarna immediate payment are only available to consumers and that payment must be made to Klarna in each case.


12 Transmission of data to the United States of America

By confirming the customer information by clicking the "Continue to Shipping" button, the customer agrees to the transmission of data to servers outside the EU in the USA.


13 Contract language

German is the only language available for the contract.

15 presale products

Within the pre-sale period, limited in time by the delivery of the respective product, the usual legal provisions apply. The withdrawal period begins on the day the goods are received (see withdrawal instructions). The buyer has the right to withdraw from the purchase contract before receiving the goods, for example in case of delivery delay or similar, without giving reasons.

16 Returns and refunds for free items

For orders over a purchase value of €200, customers receive a free jewelry box (K12 - JEWELRY BOX) as a complimentary item.

If products from the order are returned and the remaining order value falls below €200 as a result, kohlenstoff 12 reserves the right to apply the following regulations:
a) The customer receives the refund amount in the form of a voucher, or
b) The customer can exchange the products for other goods.

A full refund of the purchase price is excluded in this case.

The free jewelry box must be returned with the shipment if the remaining order value falls below €200. If the jewelry box is not returned, kohlenstoff 12 reserves the right to deduct the value of the jewelry box from the refund amount.
